1. Introduction

These Terms and Conditions (“Terms“) govern your access to and use of the website qualitypaintsupplies.co.za (the “Website“) and, where applicable, the supply of products and services by Quality Paint Supplies (“QPS“, “we“, “us” or “our“).

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

  • “Products” means the coatings and related products we distribute and supply.

All Content on the Website is owned by or licensed to QPS and is protected by intellectual property laws. The QPS name and logo are our property. Third-party trademarks, including Jotun and related product names, remain the property of their respective owners and are used with permission or for legitimate descriptive purposes.

You may view and print Content for your own internal, non-commercial reference. You may not otherwise use, reproduce or distribute Content without our prior written consent.

6. Product information, colour matching and technical advice

We take care to ensure that product descriptions, specifications and pricing on the Website are accurate. However:

  • Product information is provided for general guidance and may be updated, supplemented or superseded by the manufacturer’s current technical data sheets and safety data sheets, which take precedence.
  • Colour matching and tinting are performed using the manufacturer’s tinting system. While we keep records and strive for colour consistency as far as reasonably possible, slight variations in colour, sheen and finish can occur between batches, substrates and application conditions, and cannot be entirely eliminated.
  • Any technical advice, recommendations or support we provide is given in good faith based on the information available to us. It remains your responsibility to satisfy yourself that a Product is suitable for your intended use, substrate, environment and application method.

We do not warrant that information on the Website is complete, current or error-free, and we may correct any errors at any time.

7. Quotations, orders and pricing

  • Quotations are valid for the period stated and are subject to stock availability and confirmation by us.
  • Prices are quoted in South African Rand and are exclusive of VAT unless otherwise stated. We reserve the right to amend prices before an order is accepted.
  • The display of Products on the Website is an invitation to do business and not an offer. An order placed by you is an offer to purchase, which we may accept or decline. A binding agreement comes into existence only once we confirm acceptance of your order.
  • We reserve the right to limit quantities, refuse or cancel any order, and to require additional verification before processing an order.

8. Payment, delivery, risk and ownership

  • Payment terms will be as agreed or as set out at the point of sale. Where credit facilities apply, separate credit terms will govern.
  • Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays beyond our reasonable control.
  • Risk in the Products passes to you on delivery or collection. Ownership of the Products remains with us until payment has been received in full.
  • You are responsible for inspecting Products on delivery and notifying us of any shortage, damage or defect within 30 days.

9. Returns, cancellations and refunds

Returns and refunds are handled in accordance with our returns procedure and applicable law, including the Consumer Protection Act 68 of 2008 (“CPA”) where it applies.

Where you transact with us as a consumer through electronic communication, you may have a right to cancel certain transactions within the cooling-off period provided under the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), subject to the exceptions in that Act. Custom-tinted, colour-matched or specially mixed Products are made to your specification and may not be eligible for return, except where they are defective.

10. Warranties and disclaimers

The Website and its Content are provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all warranties, representations and conditions not expressly set out in these Terms.

Any manufacturer’s warranty applicable to a Product is provided by the manufacturer and is subject to the manufacturer’s terms. Nothing in these Terms limits or excludes any rights you have under the CPA or other applicable law that cannot lawfully be limited or excluded.

11. Limitation of liability

To the maximum extent permitted by law, QPS, its directors, employees and agents will not be liable for any indirect, incidental, special or consequential loss or damage, or any loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the Website or the Products, whether based on contract, delict, statute or otherwise.

Nothing in these Terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded.

You agree to indemnify and hold QPS harmless against any claims, losses, damages, costs and expenses arising from your breach of these Terms or your unlawful or negligent use of the Website or the Products.13. Third-party websites
